PROPOSED AGENDA

BACKGROUND:

A group of final year students had carried out an investigation through interviews and survey on the topic of the right of adopted child to inheritance. Though we understand that the law of inheritance between Muslims and non-Muslims is regulated by two different sets of rules, surprisingly, through interviews and survey results, we have observed that public knowledge of the right of the adopted child to inheritance is not yet adequate.

In this regard, we note that there are not too many materials relevant to this topic that can be readily accessed from the internet. This further strengthens our determination to intensify our efforts to bring some basic awareness of the adopted child's right to inheritance to the public.

 

PROPOSED EVENT:

OBJECTIVES:

  • To analyse the legal principles concerning the right of adopted child to inheritance. (Law of Succession and Probate)

  • To enlighten each field of knowledge regarding the theories and principles of law, justice and morality. (Jurisprudence)

  • To develop the essential skills and knowledge on alternative ways to resolve disputes without litigation. (Alternative Dispute Resolution)

 

MECHANISM:

Due to the pandemic of COVID-19, the service-learning project will be conducted through online mediums. The main event would be an online live session on the Facebook page. During the session, we would focus in explaining two key aspects:

  1. rights of adopted children to inheritance under Malaysian civil law

  2. rights of adopted children to inheritance under Islamic law

 

The session will take about 45 minutes. We will explain situations concerning Muslim or non-Muslim children who have been adopted in the event of testate and intestate. Several key lessons we have gained from interviews and studies will also be shared with the audience.

Notably, before the main event, we will post a range of infographic posters or videos to disseminate information and insight on the right of the adopted child to inheritance. We will also suggest holding sub-events such as pop quiz, lucky draw and mini competitions, if necessary.

SIGNIFICANCE:

1. Educate the public about rights of adopted children to inheritance under both Malaysian civil law and Islamic law.

Throughout this event, the audiences will have more insights regarding rights of adopted children to inheritance, regardless when the adoptive parents die testate or intestate. Such insights would ideally help to prevent any potential dispute or misunderstanding in dealing with the allocation of estates in the adoptive family.

 

2. Raise awareness of the public regarding the importance of proper estate management

Throughout the participation in this event, the audiences will ideally be more conscious of the significance of handling the estates properly. The right of the adopted child may be severely impaired if the estate is not properly distributed. In addition, it is hoped that this information will be shared with a larger base of people so that, together, it will increase awareness among the public as a whole.
